It was The Controlled Substance Act of 1970 that made hemp alongside marijuana illegal when the law designated cannabis as a schedule 1 drug. This legislation also opened the doors for hemp cultivation to be determined by individual states.

The 2018 Farm Bill federally cleared hemp for cultivation everywhere, clearing any residual confusion on the legality of industrial hemp.
